Under Section 513.653 RSMo, law enforcement agencies involved in using the federal forfeiture system under federal law shall file a report regarding federal seizures and the proceeds from those seizures.

From 8/28/2012 to 8/28/2018, the report was required to be filed annually by January 31 for the previous calendar year with the Missouri Department of Public Safety and the Office of Missouri State Auditor.  The report was a form report created by the Missouri Department of Public Safety and the Office of Missouri State Auditor titled “Missouri Law Enforcement Report:  Equitable Sharing Proceeds from Federal Forfeitures”, which was different than the federal form that had to be filed with the federal office on a different deadline.

Effective 8/28/2018, the report shall be filed annually by February 15 for the previous calendar year with only the Office of Missouri State Auditor.  The report shall consist of a copy of the federal form entitled “ACA Form – Equitable Sharing Agreement and Certification”, which is identical to the form submitted in that year to the federal government.

Therefore, a federal forfeiture reporting form shall no longer be submitted to the Missouri Department of Public Safety.  Furthermore, the “Missouri Law Enforcement Report:  Equitable Sharing Proceeds from Federal Forfeitures” form template used in previous years may no longer be used to satisfy Section 513.653 RSMo.  Law enforcement agencies involved in using the federal forfeiture system under federal law shall file a copy of the federal form to the Office of the Missouri State Auditor annually by February 15 for the previous calendar year.
