Reporting of Juveniles “Detained or Confined” within a “Jail or Lockup for Adults"

The Missouri Department of Public Safety has transitioned to an online format to collect compliance data to meet the federal reporting requirements.

Federal Fiscal Year 2022 Data Collection for Jails and Lockups for Adults Has Concluded

Pursuant to federal regulation, "detain or confine" means to hold, keep, or restrain a person such that he is not free to leave.” This includes juveniles who have been placed in cells, locked or lockable rooms that can prevent free egress, rooms with immovable cuffing devices, and areas within a secure perimeter. Juveniles who are being held by law enforcement personnel for their own safety in a non-secure area, and pending their reunification with a parent or guardian or pending transfer to the custody of a child welfare or social service agency, are not 'detained or confined' within the meaning of the JJDPA and do not need to be reported. Additionally, do not include juveniles who are released on the scene, transported directly home from the scene, or transported directly to a juvenile facility as they are outside the scope of this survey.

Data Reporting for Adult Law Enforcement Facilities WITHOUT Secure Holding Capability

As part of Missouri's compliance with the federal Juvenile Justice and Delinquency Prevention (JJDP) Act, the state must verify annually those law enforcement facilities that remain non-secure, and reclassify as secure those facilities that now have “construction features designed to physically restrict the movements and activities of individuals detained within the facility.” Construction features include cells; cuffing rings; cuffing rails; cuffing benches; secure interview rooms; etc.

Note: While this online process of reporting is new, facilities previously reported data to the Department of Public Safety on light blue-colored surveys we sent out by mail. We hope you find the new process an improvement.
